Web and Digital Services 

These Terms of Use ("Terms") govern your access to and use of the websites, digital services, and official social media platforms operated or administered by the BC Indigenous Housing Society ("BCIHS", "we", "us", or "our"), including all related domains, subdomains, portals, online applications, and BCIHS‑managed social media accounts (collectively, the "Services"). By accessing, using, or interacting with the Services, you agree to be bound by these Terms.

Changes to These Terms

BCIHS may update these Terms from time to time. When material changes are made, the updated Terms will be posted on the Site with a revised “Last updated” date. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

Privacy

BCIHS collects, uses, and discloses personal information in accordance with British Columbia’s Personal Information Protection Act (PIPA) and our Web and Digital Services Privacy Policy.

The Privacy Policy describes:

  • What personal information we collect

  • How and why it is used

  • When it may be disclosed

  • How to exercise your privacy rights

Your use of the Site is subject to that Policy.

Accounts & Access to Services 

If you create an account or interact with the Services (including through social media platforms), you agree to: 

  • Provide accurate and up‑to‑date information 

  • Keep your login credentials secure 

  • Use strong passwords and multi‑factor authentication where available 

  • Notify BCIHS within 24 hours of any suspected compromise of your account 

You are responsible for all activity conducted under your account or identity until BCIHS receives notice and has had a reasonable opportunity to act. 

Some Services may be delivered or hosted by third‑party platforms. Your use of those platforms is also subject to their respective terms and policies. 

Acceptable Use 

You agree not to: 

  • Violate any applicable provincial or federal law 

  • Infringe intellectual property, privacy, or other legal rights 

  • Upload or share content that is unlawful, threatening, abusive, harassing, hateful, discriminatory, or that promotes violence 

  • Post defamatory, fraudulent, or intentionally misleading statements 

  • Post personal information about another individual without their consent 

  • Upload malware or attempt to compromise the security or integrity of the Services 

  • Scrape, harvest, or collect data without authorization 

  • Mislead others about your identity or affiliation 

  • Post spam, solicitations, repetitive content, or content that is off‑topic or not applicable to the subject matter of the page, post, or discussion 

BCIHS may restrict, suspend, or terminate access, and may remove or limit visibility of content, where these Terms are violated or where reasonably necessary to protect users, the Site, or compliance with law. 

User‑Generated Content

If you submit content through the Services (including comments, replies, direct messages, images, or other materials), you grant BCIHS a non‑exclusive, worldwide, royalty‑free licence to host, display, reproduce, and distribute that content as necessary to operate, administer, and promote the Services.

You represent and warrant that:

  • You own or have the legal right to submit the content; and

  • The content complies with these Terms and applicable laws.

BCIHS does not claim ownership of user‑generated content, but reserves the right to manage, moderate, hide, or remove such content in accordance with these Terms.

Comments & Community Moderation

BCIHS welcomes respectful and constructive engagement across its websites and official social media platforms. Interactive areas are post‑moderated, meaning content may appear publicly before being reviewed.

The Services are privately operated and are not intended to function as public forums.

To maintain a safe, relevant, and respectful environment, BCIHS may, at its discretion and without prior notice:

  • Review, monitor, moderate, hide, remove, or limit the visibility of comments or other user‑generated content;

  • Close, pause, or restrict comment threads or interactive features;

  • Limit posting frequency or apply technical controls; and/or

  • Suspend, restrict, or block users, accounts, or access methods (including IP addresses).

Moderation actions may be taken where content or account behaviour is reasonably assessed to be:

  • Acceptable Use section of these Terms; or

  • Otherwise inconsistent with the purpose or intended use of the Services.

Moderation decisions are made to support safety, relevance, privacy, and lawful operation of the Site and do not imply endorsement of, or agreement with, any particular viewpoint. 

Request for review 

If you believe your content was moderated in error, you may request a review by contacting info@bcihs.ca and providing sufficient detail to identify the content. 

Intellectual Property

All content on the Site, including text, graphics, design, and branding, is owned by BCIHS or its licensors and protected by law.

Unless expressly permitted, you may not copy, reproduce, or create derivative works from Site content.

Third‑Party Links & Services

The Site may include links to third‑party websites or integrations. BCIHS is not responsible for their content, practices, or policies. You use third‑party services at your own risk.

Copyright & Notice‑and‑Notice

If you believe content on the Site infringes your copyright, you may submit a written notice identifying:

  • The copyrighted work

  • The location of the allegedly infringing material

BCIHS may forward qualifying notices to the relevant user under Canada’s Notice‑and‑Notice regime.

Communications & CASL Compliance

If you opt in to receive emails or newsletters, BCIHS may send commercial electronic messages in compliance with Canada’s Anti‑Spam Legislation (CASL).

All messages will identify BCIHS and provide an easy unsubscribe method.

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, BCIHS makes no warranties regarding accuracy, completeness, availability, reliability, security, or uninterrupted operation.

Your use of the Site is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, BCIHS will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, profits, goodwill, or business interruption.

BCIHS’s liability is limited to proven direct damages resulting from its breach of these Terms or negligence. Nothing in these Terms limits non‑waivable statutory rights.

Termination of Access

BCIHS may suspend or terminate access to the Site where necessary to:

  • Enforce these Terms

  • Protect security, integrity, or operations

  • Respond to unlawful activity

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. Exclusive venue for disputes is the courts of British Columbia.
